Morrissey loses Smiths London court appeal

LONDON, Nov 6 (Reuters) - Stephen Morrissey, lugubrious singer of the cult rock group The Smiths, lost an appeal on Friday against a British High Court ruling that he had short-changed two other members of the 1980s chart-toppers.

The ruling by three senior appeal judges leaves Morrissey and Smiths co-founder Johnny Marr facing a possible pay-out in the region of one million pounds ($1.66 million) and a hefty legal bill.

The long-running legal battle revolved around the division of the group's profits. Morrissey and Marr took 40 percent each while fellow-members Mick Joyce and Andy Rourke received only 10 percent each.

The High Court ruled in 1996 in a claim brought by drummer Joyce -- bass-player Rourke had settled out of court -- that this was unfair. It heard that Morrissey regarded Rourke and Joyce as ``replaceable as parts of a broken-down lawnmower.''

Morrissey and Marr were the creative force behind the Smiths, whose melancholic lyrics and haunting melodies struck a chord with society's marginalised and insecure.

Lawyers for Morrissey argued that the judge in the original hearing reached his conclusion wrongly and had made a gratuitous attack on the singer, describing him as ``devious, truculent and unreliable.''

Lord Justice Peter Gibson said on Friday the judge's criticism had ``understandably rankled'' with Morrissey but he found that the judge had dealt properly with the case.

Morrissey can still appeal to the House of Lords, the top appeal court for England and Wales.

EX APPEAL

MORRISSEY today failed in his appeal against the 1996 High Court ruling that he and Johnny Marr short changed fellow Smiths members Mike Joyce and Andy Rourke.

Three senior judges dismissed Morrissey's appeal, making him liable for a pay-out of over a million pounds to Mike Joyce - Rourke settled out of court - as well as a hefty legal bill running into hundreds of thousands of pounds.

It is not yet clear whether Morrissey intends to take the case further; it is possible that he may take his case before the House Of Lords. Leave to appeal to the House Of Lords was refused today, but Morrissey can still renew his application for leave direct to the Law Lords (which is an 'in' way of saying that he can still appeal).

The Nguyens

The Nguyens - the fab San Francisco Smiths cover band - is on a Cool Bean compilation CD, covering the "Handsome Devil" himself. Josh, the "MORRISSEY" of the Nguyens, sounds very... MORRISSEY-esque. It’s a fine cover and a nice moment of the earlier beats... with raw urges.

Billy Bragg with more references in concert

Don’t know if this is of any interest but I went to see Billy Bragg at the Manchester Academy on Wednesday night. As has been previously reported from the US shows, Billy has been attempting some Morrissey-style dancing on stage but at this show he also incorporated a Smiths lyric into one of his songs. Earlier in the show he had spoken out against the under-21s being excluded from the national minimum wage and, during the track A New England, he sang the line ‘I was looking for a job and then I found a job and Heaven knows I’m underpaid now...’ :-)

Morrissey is mentioned in context that he tried looking up the has-been, washed up, (now I am a was?!) singer for an "opening act" slot, only to find out he already died in a Chelsea hotel.

Morrissey Convention in Philadelphia, Spring 1999

In Spring of 1999, there will be a Morrissey Convention in Philadelphia. The dates are yet to be released due to some confusion about the actual space where it will be held (and putting someting like this together is quite slow-moving).. but if anyone from the Tri-State (or where ever) area in retail or otherwise would like to set up a booth of stuff to sell (non-profit organizations are definitely welcome)... Smiths on "Rock & Roll Jeopardy"

Wrong again. From Nik Pandhi:

On this past Saturday (Halloween) Rock & Roll Jeopardy had an audio daily double question in which they played "What Difference Does it Make?", and the woman who answered it guessed that it was Morrissey. The announcer told her it was incorrect and then she immediately said it was The Smiths (too little too late). Hence, she lost alot of money and rightly so. I just thought this would be an interesting tidbit.
