An anonymous person writes:
This weekend Andy Rourke was guest-dj at the indie-club Step On in Stockholm, Sweden. I got to meet him a bit, have a pint together and a little chat. We talked a bit about his days with The Smiths, he signed a few of my records and was dead nice. Then I led the conversation into what I've always been curious about; what Rourke thought of Morrissey's solo stuff. He claimed not to have heard a great deal of it, but he added something interesting: Rourke said that he still hadn't received royalties for the songs he's written with Morrissey ("Yes, I Am Blind" and "Girl Least Likely To"), at least not for the appearance of the latter on what he called "that My Pickpocket Days-record or whatever it was called". He also added that: "but then again, that's Morrissey for ya. It doesn't surprise me though, he's never been that kind of person to reach into his pocket and pay the people around him". Thought this might be of interest.

Look, anyone can defend Moz with emotions and say "He doesn't deal with payments" or "I don't believe it. Moz wouldn't do that. He's my idol."
But, the FACTS have been published on several occasions about his poor business dealings, etc. and I tend to go with those. I mean, think of all the people who have had a problem with him...and you think all THOSE people are the source of the problem and not the one man whose the only constant!

The person employed by the band to deal with the financial matters would then pay all people that are entitled. Most of the times, the person responsible would be the band manager.
You can guess by now two vital points re. the Smiths... (1) The Smiths never had a true manager after Joe Moss and (2) the band and all its legal forms and subsidiaries have been defunct since 1987.
So, that left the financial dealings up to 1987 the responsibility of the "CEOs" of the band, i.e. Morrissey and Marr. After 1987, they remained, as former CEOs, responsible -- which is why M&M were personally sued by Mike Joyce, Craig Gannon et al.
As for Morrissey solo, he is the CEO of his own one-man company, and hires the people around him, be they band members, (road) managers, etc., and the publishing company pays his Morrissey Ltd (or whatever) the royalties, expecting it to pass the money to those involved.

Just stirring. The same could be said for Johnny Marr and various T-Rex, Elvis and Beatles tracks. And if one had the time to read all of Western literature and watch every movie, you'd probably find every lyric Moz ever 'wrote'. Is Moz's approach to lyrics the wordsmith's equivalent of sampling?

I am tired of Morrissey-Bashing (Score:1)
To be as financially irresponsible as *so* many people claim would be suicidal. Morrissey is not about to throw away his career or his artistry.
I realize the music industry can be dog-eat-dog, but I will not believe the following:
1. Morrissey is in charge of royalty cheques to others.
2. Morrissey deliberately cheats others out of money.
3. Morrissey 'expects' people to work for him pro bono.
4. Morrissey plots to line his pockets at the expense of others.
5. Morrissey is in charge of paying the band and crew.
I do believe that Morrissey has good lawyers and fair contracts related to most of his business associates. I also believe that he has insurance for all of his endeavors.
I do believe that money disagreements and shortcomings do and can occur, and that many of these are not withing Morrissey's control. I am not a lawyer, but to screw everyone you work with is suicidal and not like Morrissey.

The truth on royalties... (Score:1)
There are two types of royalties an artist may get
* Recording Artist Royalties (which apply to any artist signed to a record deal)
* Publishing Royalties (which apply to any writer who receives a "writing credit" for a song)
Mr. Rourke complaining about Moz having to pay HIM songwriting royalties is LUDICROUS! That's what publishing companies are for: they collect monies from all over the world and pay writers or whomever has a songwriting credit for songs. If Mr. Rourke is NOT getting his publishing royalties he should be complaining to the publishing Company that represents his interests, given that he HAS a songwriting credit for those songs. If he doesn't have a songwriting credit (he may have been stupid enough to give it up), tough luck, he is not entitled to squat!
Mr. Rourke would be entitled to artist royalties from Morrissey's records if and only IF he has a "producer" or "featured artist" royalty and a contract is in place between Moz/Mr. Rourke and Warner. In this case producer royalties are usually "deducted" from the artist's royalties and paid directly to the producers of a said track. There are a lot of other issues that tie into the producers getting paid or not, but it's way too complex to explain here. In any case, if Mr. Rourke has a contract providing for him to receive "producer" or "featured artist" royalties, then he must take it up with Warner Bros who issued the release and STOP WHINING LIKE A CRY BABY ABOUT HOW MOZ IS CHEATING HIM OR IS SUPPOSED TO PAY HIM! ENOUGH ALREADY!
Advice to Mr. Rourke: If you believe you have any claims against royalties I could suggest a few auditing firms that specialize in royalty audits, I used to work for one.
